Terms of Service

1. Introduction

These Terms of Service ("Terms") govern access to and use of the Capino platform ("Service") – a web application that provides access to English grammar tests, AI-powered error explanations, and personalized learning tools.

By purchasing access and using the Capino platform, you agree to these Terms, which form a public agreement (offer) under Article 633 of the Civil Code of Ukraine.

The Service is owned and administered by FOP Mizura Mykhailo Serhiyovych (the "Seller").

2. Definitions

• Service – providing digital access to Capino grammar tests, AI explanations, and (when available) adaptive learning.
• Buyer / User – an individual or legal entity who makes a payment and receives access to the Service.
• Platform – the website www.capino.app.
• Seller – FOP Mizura Mykhailo Serhiyovych, administrator of the Capino platform.

3. Subject of the Agreement

3.1. The Seller provides the Buyer with access to Capino tests, and the Buyer undertakes to pay for them in accordance with these Terms. 3.2. The agreement is considered concluded from the moment payment is received in the Seller’s account. 3.3. After successful payment, access to Capino tests is provided within 24 hours.

4. Access and Payment

4.1. The current price for accessing Capino tests is always displayed on the landing page or checkout page at the time of purchase. 4.2. Prices may change without prior notice; changes do not affect already paid orders. 4.3. Payment is made via the available methods shown on the website. 4.4. Once paid, the Buyer receives lifetime access – no subscriptions or recurring fees.

5. Refund Policy

If the Service does not meet your expectations, including delays or failures in access, you may request a refund within 30 days of purchase.

To request a refund, email capino.app@gmail.com and describe the issue. Refunds are processed to the same payment method used for purchase.

6. User Obligations

6.1. You must be 18 years or older to use the Service. 6.2. You agree to use the platform lawfully and not to abuse its content or features. 6.3. You are responsible for the accuracy of the information provided during registration and payment. 6.4. Access credentials (if provided) are personal and must not be shared with third parties.

7. Intellectual Property

7.1. All Capino content – including tests, AI explanations, design, and source code – is the intellectual property of the Seller or its licensors. 7.2. You may not copy, distribute, resell, or commercially use any part of the platform without prior written permission.

8. Liability and Disclaimers

8.1. The Service is provided “as is” without guarantees of uninterrupted operation or achievement of specific learning results. 8.2. The Seller is not responsible for:

• technical interruptions caused by hosting providers, payment systems, or external factors;
• indirect, incidental, or consequential damages related to use of the Service;
• the effectiveness of the Buyer’s learning or interpretation of provided explanations. 8.3. The Seller’s maximum liability is limited to the amount actually paid for the Service.

9. Privacy and Data Protection

9.1. By using the Service, you consent to the processing of your personal data as described in our Privacy Policy. 9.2. The Seller does not share personal data with third parties except as required by law.

10. Modifications

10.1. The Seller may update these Terms at any time by publishing a new version on the website. 10.2. Updated Terms apply only to new purchases made after the date of publication.

11. Applicable Law

11.1. These Terms are governed by the laws of Ukraine. 11.2. Any disputes are resolved through negotiation or in court under Ukrainian jurisdiction.
